It's more complicated than that, dammit!
If I were the FCC Commissioner -- and I propose immediate deposition into a wood chipper for anyone who doesn't think my appointment as the Commissioner would be a great idea -- I'd rip out most of the telecom regulations already in existence and replace them with ONE regulation:
1. You can be a provider of last-mile circuits, *or* you can be a provider of services (voice, data, video, etc). You can't be both.
I've posted about this before. It's a one-step solution that fixes *everything*.
There's no difference between local and long distance. There's no difference between voice and data. There's no difference between public and private networks. The moment you are granted space on the utility poles or in the underground conduits, your *only* job is to operate a local network that connects service providers with subscriber premises.
If last-mile network operators were prohibited from being service providers, and were obligated to sell connectivity to all service providers at the same price, the network would be "neutral by nature" without the need for any further regulation.
My solution is, of course, perfect, and therefore would be frowned upon by both government and corporate types.
It remains to be seen what the FCC will do with their new authority but I'm worried enough. Everybody misunderstands what's happening with Netflix, for instance.
